Where does Literacy Counts store personal information?

Literacy Counts is based in the EU.

  • Literacy Counts resources are used and can be accessed across the planet and it is important that the personal information of our customers and our own people is handled in accordance with GDPR.

  • Our data protection governance arrangements and privacy mindset ensure that our operations are subject to continuous review to maintain alignment with GDPR as we introduce new products and services.

  • Our Third-party service providers operate under the same regulatory regimes, and we select industry standard suppliers to ensure that we can deliver the best products and services.

 

How can I request access to my personal information?

We have online information for Ready Steady Literacy users or get in touch with our Head Office Team.

  • We provide secure online self-service access to account information for our customers via the website.

  • If you need further information additional to that available through our online channels our customers can contact Literacy Counts by telephone or email who will be pleased to assist with general enquiries.

  • Existing legislation and GDPR require organisations to respond to data subject access requests, Literacy Counts is already able to do so

  • We will need to authenticate your identity to ensure we handle any request securely.

No functional change is anticipated for Literacy Counts products, however as part of our GDPR have upded our Privacy Policy, these will be published.

  • Literacy Counts Privacy Policies have been updated to contain wording that aligns with the requirements of GDPR.

  • Where users have already consented to receiving material such as the Literacy Counts Training Newsletter, we provide the ability for users to change or withdraw consent, for example adapting the frequency of newsletter or unsubscribing.

For the purposes of the Data Protection Act 1998, Literacy Counts Limited (‘we’ or ‘us’) is the ‘data controller’ (i.e. the company who is responsible for, and controls the processing of, your personal data).

Personal data

We will obtain personal data about you (such as your name, address, email address, telephone number, role) when you sign up to use our services.  When you sign up for our newsletter, we will obtain your name and email address. 

We may also obtain sensitive personal data about you if you volunteer it during the completion of an online form. If you volunteer such information, you will be consenting to our processing it for the purpose of providing our training.

We may monitor your use of this website through the use of cookies and similar tracking devices. For example, we may monitor how many times you visit, which pages you go to, traffic data, location data and the originating domain name of a user’s internet service provider.  This information helps us to build a profile of our users. Some of this data will be aggregated or statistical, which means that we will not be able to identify you individually.

Member Space

 

When accessing some Ready Steady literacy products there is a requirement to set up a Members Space account and we may collect two types of information: (1) personally identifiable information: and (2) information this is not personally identifiable. Personally, identifiable information includes information that identifies you personally, alone or in combination with other information available to us. E.g. names, school, role.  As part of the standard operation of Member Space you will need to submit personally identifiable information when creating a user account.

We will also collect non-personal information from you, including browser type, operating system, IP address from where you access the site. As well as written information stored as part of the use of the services e.g. blogs, reviews and polls. We may also collect information about your browsing behaviour for example when you log in and how often and which pages you might visit whilst browsing this is to inform us on development tasks.

We will use your personal data for a number of purposes. These purposes include:

  • To help us identify you and any accounts you hold with us

  • Administration

  • Research, statistical analysis and behavioural analysis

Information about other individuals

If you give us information on behalf of someone else, you confirm that the other person has appointed you to act on their behalf and has agreed that you can:

  • Give consent on their behalf to the processing of their personal data

  • Receive on their behalf any data protection notices

  • Give consent to the transfer of their personal data abroad 

  • Give consent to the processing of their dietary requirements.

 

Your Rights

You have the right, subject to the payment of a small fee (currently £20), to request access to personal data that we may process about you. If you wish to exercise this right, you should:

  • Put your request in writing

  • Include proof of your identity and address (e.g. a copy of your driving licence or passport, and a recent utility or credit card bill)

  • Attach a cheque in the amount of £20 made payable to Literacy Counts Limited

  • Specify the personal data you want access to, including any account or reference numbers where applicable.

 

You have the right to require us to correct any inaccuracies in your data free of charge. If you wish to exercise this right, you should:

  • Put your request in writing

  • Provide us with enough information to identify you 

  • Specify the information that is incorrect and what it should be replaced with.

 

You also have the right to ask us to stop processing your personal data for direct marketing purposes. If you wish to exercise this right, you should:

  • Put your request in writing (an email sent admin@literacycounts.co.uk with a header that says ‘Unsubscribe’ is acceptable)

  • Provide us with enough information to identify you if your objection is not to direct marketing in general, but to direct marketing by a particular channel (eg email or telephone), specify the channel you are objecting to.

Terms of Use

The term ‘Ready Steady Literacy’ will be used to cover all of the literacy products for schools outlined above.

Literacy Counts Ltd provides a personalized  membership service through subscription that allows our members i.e. schools and their employees that teach children) to access entertainment online content (“Ready Steady Literacy") over the Internet on certain Internet-connected TVs, computers, Interactive Whiteboards, Tablets and other devices ("Ready Steady Literacy ready devices").

These Terms of Use govern your use of our service. As used in these Terms of Use, "Literacy Counts Ltd", "our service" or "the service" means the personalised digital content service provided by Literacy Counts Ltd for discovering, accessing and using Ready Steady Literacy content, including all features and functionalities and our websites, and user interfaces, as well as all content and software associated with our service.

References to ‘you’ in these Terms of Use indicate the membership service through subscription and/or institution who created the Ready Steady Literacy account with Literacy Counts Ltd and whose payment method is charged or invoiced annually..

 

1:1 Membership

Your Ready Steady Literacy membership service through subscription will continue until terminated. Termination of membership cannot be partway through and academic year for annual subscriptions. Subscriptions are annual and renewed annually.  To use the Ready Steady Literacy resources from Literacy Counts Ltd service you must have Internet access and a Ready Steady Literacy ready device and provide us with one or more Payment Methods.

 "Payment Method" means a current, valid, accepted method of payment, as may be updated from time to time, and which may include payment through your account with a third party. Unless you cancel your membership before your annual billing date, you authorize us to charge the membership service through subscription fee for the next billing cycle to your Payment Method (see "Cancellation" below).

 

1:2 1.2. We may offer a number of membership plans, including memberships offered by third parties in conjunction with the provision of their own products and services. Some membership plans may have differing conditions and limitations, which will be disclosed at your sign-up or in other communications made available to you. You can find specific details regarding your Ready Steady Literacy membership by visiting the Ready Steady Literacy.com website and clicking on the "Account" link available at the top of the pages under your profile name.

Promotional Offers

We may from time to time offer special promotional offers, plans or memberships (“Offers”). Offer eligibility is for Ready Steady Literacy and / or users of other Ready Steady Literacy Resources produced by Literacy Counts Ltd is determined by Literacy Counts Ltd at its sole discretion and we reserve the right to revoke an Offer and put your account on hold in the event that we determine you are not eligible. Members of households  institutions with an existing or recent Ready Steady Literacy (or any Ready Steady Literacy products and services produced by Literacy Counts Ltd) membership may not be eligible for certain introductory Offers. We may use information such as device ID, method of payment or an account email address used with an existing or recent membership of Literacy Counts Ltd membership through subscription to determine Offer eligibility. The eligibility requirements and other limitations and conditions will be disclosed when you sign-up for the Offer or in other communications made available to you.

 

 

2: Billing & Payments

2:1 Billing Cycle

The membership fee and member ship fee renewal for the Ready Steady Literacy service will be charged by Literacy Counts Ltd to your Payment Method or invoiced in the summer term each year (i.e., June, July or August) before the subsequent academic school year commences.  The length of your billing cycle will therefore be annual.  For a new schools that gains membership service and access to Ready Steady Literacy through subscription during the academic year a charged for the term in which the account is activate and any subsequent term(s) that remain in the academic year from membership account set up for the service. Renewals following this will fall into the annual billing cycle.  In some cases, your payment window date (June & July) may change, for example if your Payment Method has not successfully settled, when you change your subscription plan or if your paid membership began during the academic year. If you signed up for Ready Steady Literacy using your account with a third party as a Payment Method, you can find the billing information about your Ready Steady Literacy membership by visiting your account with the applicable third party.

 

2:2 Payment Methods

To use the Ready Steady Literacy produced by Literacy Counts Ltd service you must provide one or more Payment Methods. You authorize us to charge any Payment Method associated to your account in case your primary Payment Method is declined or no longer available to us for payment of your subscription fee. If by payment by invoice you authorise us to raise an invoice. Payment methods include invoices that will be automatically sent to you unless you make Literacy Counts Ltd aware of the Cancellation of Ready Steady Literacy.  You remain responsible for any uncollected amounts. If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not cancel your account, we may suspend your access to the service until we have successfully charged a valid Payment Method. For some Payment Methods, the issuer may charge you certain fees, such as foreign transaction fees or other fees relating to the processing of your Payment Method. Local tax charges may vary depending on the Payment Method used. Check with your Payment Method service provider for details.

 

3.3 Updating your Payment Methods

You can update your Payment Methods by contacting Literacy Counts Ltd. We may also update your Payment Methods using information provided by the payment service providers. Following any update, you authorize us to continue to charge the applicable Payment Method(s).

 

3.4 Cancellation

You can cancel your annual Ready Steady Literacy membership at any time during the academic year for the subsequent academic year, and you will continue to have access to the Ready Steady Literacy service through the end of your billing period. Payments are non-refundable and we do not provide refunds or credits for any partial membership periods or unused Ready Steady Literacy content. To cancel, contact Literacy Counts Ltd. If you cancel your membership, your account will automatically close at the end of your current billing period.

 

3.5 Changes to the Price and Subscription Plans.

We may change our subscription plans for Ready Steady Literacy and the price of our service from time to time; however, any price changes or changes to your subscription plans will apply no earlier than 30 days following notice to you. If you do not wish to accept the price change or change to your subscription plan, you can cancel your subscription before the change takes effect.

 

4: Confidentiality & Access

4.1 Confidentiality of Ready Steady Literacy

The Ready Steady Literacy online membership through a subscription service and any content accessed through the service are for your school and its practitioners’ professional and non-commercial use only.  Access and content may not be shared with individuals beyond your household institution for example other schools, other educational institutions, home tutors / tutoring services, parents and carers of pupils etc.   Ready Steady Literacy may not be shared with competitors, or any employee associated personally or professionally with or to a competitor. Ready Steady Literacy, therefore, may not be shared with any business providing educational resources, subscriptions or services that relate to reading, early reading (including phonics), writing, consultancy and training services for schools. Literacy Counts Ltd that produce and invented Ready Steady Literacy regularly monitors access locations. Reproduction, storage, modification, adaptation or translation, in any form or by any means, of this online resource and its associated downloadable content including media content is prohibited without the prior written permission of Literacy Counts Ltd. The resource cannot be used for commercial purposes. Literacy Counts Ltd will charge schools and individuals who use our products & subscriptions without our agreement and / or purchase.

During your Ready Steady Literacy membership, Literacy Counts Ltd grant you a limited, non-exclusive, non-transferable right to access Ready Steady Literacy content. Except for the foregoing, no right, title or interest shall be transferred to you. You agree not to use the service for public performances and commercial gain.

We may terminate or restrict your use of our service if you violate these Terms of Use or are engaged in illegal or fraudulent use of the service.

4.2 Access

 You may access the Ready Steady Literacy content primarily within the school in which you have established your account / membership and only in this geographical location.  

As part of the Ready Steady Literacy subscription, only Ready Steady Literacy resources and materials will be accessible as part of the membership access through a ad subscription plan. The number of devices on which you may simultaneously watch depends on your chosen subscription plan and is specified on the "Account" page.

4.3 Ready Steady Literacy online membership

Ready Steady Literacy online membership through subscription and associated services, including the content library, is regularly updated. In addition, we continually test various aspects of our service, including our websites, user interfaces and promotional features. You can turn off test participation at any time by visiting the "Account" page and changing the "Test participation" settings.4.5. Depending on your subscription plan, some Ready Steady Literacy content may be available for temporary download and offline viewing on certain supported devices ("Offline Titles"). Limitations apply, including restrictions on the number of Offline Titles per account, the maximum number of devices that can contain Offline Titles, the time period within which you will need to begin viewing Offline Titles and how long the Offline Titles will remain accessible. Some Offline Titles may not be playable in certain countries and if you go online in a country where you would not be able to stream that Offline Title, the Offline Title will not be playable while you are in that country.

 

4.4 Except as explicitly authorized by us, Literacy Counts Ltd, you agree not to:

(i) archive, reproduce, distribute, modify, display, perform, publish, license, create derivative works from, offer for sale, or use content and information contained on or obtained from or through the Ready Steady Literacy service;

(ii) circumvent, remove, alter, deactivate, degrade, block, obscure or thwart any of the content protections or other elements of the Ready Steady Literacy service, including the graphical user interface, any advertising or advertising features, copyright notices, and trademarks;

(iii) use any robot, spider, scraper or other automated means to access the Ready Steady Literacy service produced by Literacy Counts Ltd;

(iv) decompile, reverse engineer or disassemble any software or other products or processes accessible through the Ready Steady Literacy service;

(v) insert any code or product or manipulate the content of the Ready Steady Literacy service in any way;

(vi) use any data mining, data gathering or extraction method;

(vii) upload, post, e-mail or otherwise send or transmit any material designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment associated with the Ready Steady Literacy and Literacy Counts and its associated products and services, including any software viruses or any other computer code, files or programs

We may terminate or restrict your use of our service if you violate these Terms of Use or are engaged in illegal or fraudulent use of the service.

 

4.5 The quality of the display

The quality of the Ready Steady Literacy content may vary from device to device, and may be affected by a variety of factors, such as your location, the bandwidth available through and/or speed of your Internet connection. HD, Ultra HD and HDR availability is subject to your Internet service and device capabilities. Not all content is available in all formats, such as HD, Ultra HD and HDR, and not all subscription plans allow you to receive content in all formats. The minimum connection speed for HD video quality (defined as a resolution of 720p or higher) is 3.0 Mbps per stream; however, we recommend a faster connection for improved video quality. A connection speed of at least 5.0 Mbps per stream is recommended to receive Full HD video quality (defined as a resolution of 1080p or higher). A connection speed of at least 15.0 Mbps per stream is recommended to receive Ultra HD video quality (defined as a resolution of 4K or higher). You are responsible for all Internet access charges. Please check with your Internet provider for information on possible Internet data usage charges. The time it takes to begin watching  accessing Ready Steady Literacy content will vary based on a number of factors, including your location, available bandwidth at the time, the content you have selected and the configuration of your Ready Steady Literacy ready device.

4.6 Ready Steady Literacy software

Ready Steady Literacy software is developed by, Literacy Counts Ltd and may solely be used for authorized streaming and to access to Ready Steady Literacy content through Ready Steady Literacy ready devices. This software may vary by device and medium, and functionalities and features may also differ between devices. You acknowledge that the use of the service may require third party software that is subject to third party licenses. You agree that you may automatically receive updated versions of the Ready Steady Literacy software and related third-party software.

 

5: Passwords and Account Access

5: 1 Passwords and Account Access

Your password is for your personal school use only and should be kept confidential. If you allow others to access the account (which includes access to information on viewing activity for the account), you agree that such individuals are acting on your behalf and/or are within your institution and that you are bound by any changes that they may make to the account, including but not limited to changes to the subscription plan. To help maintain control over the account and to prevent any unauthorized users from accessing the account, you should maintain control over the devices that are used to access the service and not reveal the password or details of the Payment Method associated with the account to anyone. You agree to provide and maintain accurate information relating to your account, including a valid email address so we can send you account related notices. We can terminate your account or place your account on hold in order to protect you, Ready Steady Literacy or our partners from identity theft or other fraudulent activity. You agree to update your account information in the circumstance that members of staff leave your institution but may still be able to access Ready Steady Literacy. You agree to change your password so that individuals outside of your institution can no longer access Ready Steady Literacy.

 

6: Miscellaneous

6.1 Customer Support

To find more information about our other services and their features or if you need assistance with your account, please contact us. Details are , which is accessible through the literacy Counts Ready Steady Literacy.com website (www.literacycounts.co.uk). In certain instances, Customer Service may best be able to assist you by using a remote access support tool through which we have full access to your computer. If you do not want us to have this access, you should not consent to support through the remote access tool, and we will assist you through other means.

6.2 Survival

If any provision or provisions of these Terms of Use shall be held to be invalid, illegal, or unenforceable, the validity, legality and enforceability of the remaining provisions shall remain in full force and effect.

 

 

6.3 Changes to Terms of Use

Literacy Counts Ltd may, from time to time, change these Terms of Use. We will notify you at least 30 days before such changes apply to you. If you do not wish to accept the changes, you can cancel your subscription to end at the end of that academic year.

6.4 Electronic Communications

We will send you information relating to your account (e.g., payment authorizations, invoices, changes in password or Payment Method, confirmation messages, notices) in electronic form only, for example via emails to your email address provided during registration.
